Welcome to BestBid ("we," "us," or "our"). By accessing or using the BestBid website and services at bestbid.dev (the "Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

1. Description of Service

BestBid is a tool that uses publicly available real estate data, comparable sales analysis, and automated valuation models to generate estimated property values and bid recommendations. The Service is designed to assist you in making more informed decisions during the home-buying process.

BestBid is an informational tool only. It is intended to provide a starting point for your research and decision-making. It is not a substitute for professional advice, independent research, or your own due diligence.

2. Not Financial, Legal, or Professional Advice

Nothing on this website constitutes financial advice, investment advice, legal advice, tax advice, or any other form of professional advice. BestBid does not recommend that you buy, sell, or bid any specific amount on any property. All information provided is for general informational and educational purposes only.

You should consult with qualified professionals — including licensed real estate agents, appraisers, financial advisors, and attorneys — before making any real estate purchase or financial decision.

3. Not an Appraisal

BestBid's valuations and bid recommendations are computer-generated estimates. They are not appraisals and cannot be used as a substitute for a professional appraisal performed by a licensed or certified appraiser. Our estimates:

  • Do not constitute an appraisal as defined under the Uniform Standards of Professional Appraisal Practice (USPAP) or any state or federal regulations.
  • Should not be used for lending, mortgage qualification, legal proceedings, tax assessment challenges, or any other purpose that requires a certified appraisal.
  • Have not been prepared or reviewed by a licensed appraiser.

If you need a property appraisal, you must engage a licensed or certified real estate appraiser in your jurisdiction.

4. Accuracy and Limitations

While we strive to provide useful and reasonable estimates, BestBid makes no guarantee or warranty as to the accuracy, completeness, reliability, or timeliness of any information provided through the Service. Our estimates may be inaccurate for a number of reasons, including but not limited to:

  • Market conditions: Real estate markets change rapidly. Local supply and demand, interest rates, economic shifts, seasonal patterns, and other factors can cause actual market values to differ significantly from our estimates.
  • Data limitations: Our models rely on publicly available data sources, including MLS records and county records. This data may be incomplete, outdated, or contain errors. Not all property features, improvements, or conditions are reflected in public records.
  • Property-specific factors: Interior condition, renovations, undisclosed defects, environmental hazards, zoning changes, neighborhood dynamics, and other factors that are not captured in our data may substantially affect a property's actual value.
  • Model limitations: Automated valuation models are statistical tools that work from historical patterns. They cannot account for unique property characteristics, buyer-specific preferences, negotiation dynamics, or future market changes.

The actual sale price of a property may differ materially from any estimate provided by BestBid. Past performance of our estimates is not indicative of future accuracy.

5. Your Use of the Service

BestBid is designed to be one of many tools you use in your home-buying research. We encourage you to:

  • Conduct your own independent research on any property you are considering.
  • Obtain a professional appraisal before making a significant financial commitment.
  • Work with a licensed real estate agent who has local market expertise.
  • Request a comparative market analysis (CMA) from a real estate professional.
  • Visit properties in person and assess their condition firsthand.
  • Consult with a financial advisor regarding your budget and affordability.

You acknowledge that any reliance on information provided by BestBid is at your own risk. You are solely responsible for any decisions you make based on the information provided through the Service.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • Any warranty regarding the accuracy, reliability, completeness, or timeliness of any content, data, estimates, or recommendations provided through the Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTBID, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities.
  • Financial losses resulting from real estate transactions, bids, purchases, or sales made in reliance on information obtained from the Service.
  • Damages arising from the inaccuracy or incompleteness of any estimate, valuation, or recommendation.
  • Any damages resulting from your inability to use the Service or from unauthorized access to your account.

In no event shall our total aggregate liability to you for all claims arising from or related to the Service exceed the amount you have paid to BestBid in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

8. Assumption of Risk

You expressly acknowledge and agree that:

  • Real estate transactions involve substantial financial risk.
  • No automated tool or model can predict market outcomes with certainty.
  • You assume all risk associated with your use of the Service and any decisions made based on the information it provides.
  • You will not hold BestBid responsible if a property's actual value, sale price, or market performance differs from our estimates, regardless of the magnitude of the difference.

9. User Accounts

To access the Service, you must create an account and verify your email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to update your information as needed.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Reproduce, redistribute, scrape, or commercially exploit any data, estimates, or content from the Service without our prior written consent.
  • Attempt to interfere with, compromise, or disrupt the Service or its underlying infrastructure.
  • Use automated tools, bots, or scripts to access the Service in a manner that exceeds reasonable use.
  • Represent any BestBid estimate as an appraisal or as professional advice to any third party.

11. Intellectual Property

All content, features, functionality, designs, and trademarks associated with the Service are owned by BestBid and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

12. Third-Party Data and Links

The Service may incorporate data from third-party sources and may contain links to third-party websites. We do not control and are not responsible for the accuracy, completeness, or availability of any third-party data or content. The inclusion of any third-party data or link does not imply endorsement by BestBid.

13. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We may also update these Terms of Use from time to time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the state in which BestBid operates, without regard to its conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of that jurisdiction.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and BestBid regarding your use of the Service and supersede all prior agreements and understandings.
